A Richmond man who was charged with rolling his truck while driving while intoxicated near Woodstock when he was 19 has pleaded guilty to a single misdemeanor charge of DUI. Nathan Madula, who is now 21, was sentenced to 24 months of probation and 300 hours of community service following the plea deal accepted on January 22, court records show. The McHenry County Sheriff's Office and Woodstock Fire/Rescue District responded around 6:45 p.m. on December 13, 2023, to the 4900 block of Route 47 in unincorporated Woodstock for a vehicle crash with injuries. An investigation showed Madula's 2003 Ford truck was traveling northbound on Route 47 south of Allendale Road when it crossed into the southbound lane and exited the roadway, rolling over several times. Both Madula and an 18-year-old passenger were ejected from the vehicle and suffered critical, life-threatening injuries.

Safety tips

Driving under the influence of alcohol or drugs can have devastating consequences. Here are some important safety tips to keep in mind:

  • Never drive after consuming alcohol or using drugs. Call a taxi, use a rideshare service, or have a sober friend or family member drive you.
  • Wear your seatbelt every time you get in a vehicle. Seatbelts save lives.
  • Obey all traffic laws, including speed limits and lane markings.
  • Avoid distractions like cell phones, eating, or adjusting the radio while driving.
  • Get enough sleep before driving and take breaks on long trips to avoid fatigue.
  • Maintain your vehicle and ensure all lights, tires, and safety features are in good working order.
  • Be extra cautious in inclement weather or low visibility conditions.
  • Never ride with a driver you suspect may be impaired.

Dram Shop Liability in Illinois

Illinois law recognizes dram shop liability, which allows injured parties to also seek compensation from businesses that served alcohol to a visibly intoxicated individual who later caused a motor vehicle crash. While these cases depend on specific facts, dram shop claims may play an important role in serious DUI or DWI injury cases.

Illinois statute of limitations

In Illinois, the statute of limitations for personal injury claims is generally two years from the date of the incident. Deadlines can vary by situation. This is general information, not legal advice.

It is important to take timely action, as waiting too long can jeopardize your ability to recover compensation for your injuries and other losses.
